Who is a citizen of India?

The following persons are considered citizens of India:
  1. As on 26 January 1950, every person who has their domicile in India (primarily stays in India) and (section 5)
    • who was born in India
    • either of whose parents was born in India
    • who was ordinarily resident in India from at least 26 January 1945
  2. As on 26 January 1950, any person who migrated from Pakistan and whose parents were born in India, or who was ordinarily resident in India for a certain specified period of time (article 6)
  3. Any person who was born in India, or whose parent(s) or grandparent(s) was born in India, who is ordinarily resident outside India, but who registers with the Indian embassy as a citizen of India (article 8)
The following persons are excluded from citizenship:
  1. Any person who migrated from India to Pakistan after 1 March 1947 (article 7)
  2. Any person who voluntarily acquires the citizenship of any other country (article 9)
Additional provisions:
  1. All citizens are subject to the laws made by the Parliament of India (article 10)
  2. The Parliament can modify the rules related to the acquisition, termination, and all other matters related to citizenship (article 11)
