Who is a citizen of India?
...
- As on 26 January 1950, every person who has their domicile in India (primarily stays in India) and (section 5)
- who was born in India
- either of whose parents was born in India
- who was ordinarily resident in India from at least 26 January 1945
- As on 26 January 1950, any person who migrated from Pakistan and whose parents were born in India, or who was ordinarily resident in India for a certain specified period of time (article 6)
- Any person who was born in India, or whose parent(s) or grandparent(s) was born in India, who is ordinarily resident outside India, but who registers with the Indian embassy as a citizen of India (article 8)
The following persons are excluded from citizenship:
- Any person who migrated from India to Pakistan after 1 March 1947 (article 7)
- Any person who voluntarily acquires the citizenship of any other country (article 9)
Additional provisions:
- All citizens are subject to the laws made by the Parliament of India (article 10)
- The Parliament can modify the rules related to the acquisition, termination, and all other matters related to citizenship (article 11)
